Terms and Conditions
I. Scope of Application, Conclusion of Contract
The Mühlviertel Tourism Association acts as an intermediary in its business relationship with a booking party. A contract is therefore concluded between the booking party and the accommodation provider (AP). The following General Terms and Conditions, in the version valid at the time of booking, apply to this contract. Any mutual claims arising from this contract may only be asserted against the direct contractual partner and without any liability or joint liability on the part of the Mühlviertel Tourism Association. The Mühlviertel Tourism Association will agree with the booker that the “General Terms and Conditions for the Hotel Industry (ÖHVB)” adopted by the hotel industry on November 15, 2006, as well as the supplementary General Terms and Conditions listed here, shall be legally binding for the accommodation contract and for the mediation thereof.
II. The following excerpts are taken from the current General Terms and Conditions for Accommodation (AGBH) 2006, specifically the section titled “Withdrawal from the Accommodation Contract – Cancellation Fee” (§ 5):
- 5.1 If the accommodation contract provides for a deposit and the contracting party has not paid the deposit by the due date, the accommodation provider may withdraw from the accommodation contract without granting a grace period.
- 5.4 Up to 92 days before the contractual partner’s agreed arrival date, the accommodation contract may be terminated by the accommodation provider through a unilateral declaration for objectively justified reasons, unless otherwise agreed.
- 5.5 Up to 92 days before the guest’s agreed arrival date, the accommodation contract may be terminated by the contracting party through a unilateral declaration without payment of a cancellation fee.
- 5.6 Outside the period specified in § 5.5, the contracting party may cancel the contract by unilateral declaration only upon payment of the following cancellation fees: - up to 30 days prior to the arrival date: 40% of the total package price; - up to 7 days prior to the arrival date: 70% of the total package price; - 6 days prior to the arrival date: 90% of the total package price.
III. Supplementary General Terms and Conditions:
- 1. The reservation becomes valid only upon the host’s confirmation of the reservation. Without such confirmation, no valid contract is formed, and the guest has no assurance that the reserved service will actually be available.
- 2. The contracting parties agree that Austrian law shall govern both the accommodation contract and the agency contract.
- 3. No collateral agreements have been made.
- 4. Amendments and additions to this contract must be in writing to be legally effective.
- 5. For disputes arising from this legal transaction—including those regarding the validity of the legal transaction—the jurisdiction of the District Court of Rohrbach-Berg is agreed upon.
- 6. The place of performance for the services of the Mühlviertel Tourism Association is the municipality of Bad Leonfelden.
- 7. The accommodation provider expressly confirms that the General Terms and Conditions for Accommodation (AGBH) 2006 are legally binding for all bookings; furthermore, the accommodation provider declares that it is fully acquainted with the General Terms and Conditions, has received a copy thereof, and accepts them in their entirety for every booking.
- 8. The Mühlviertel Tourism Association guarantees that customer data will be collected, processed, stored, and used for its own marketing purposes solely in connection with the processing of travel arrangements. The Mühlviertel Tourism Association will only share customer data with the relevant accommodation providers to the extent necessary for order processing. If guests do not wish to receive marketing information, we ask that they notify us accordingly.
- 9. No guarantee is provided regarding the accuracy of the image material provided by the accommodation providers.
